Eggi Sudjana Datangi Bawaslu Agar KPUD DKI Batalkan Cagub Ahok

Jakarta, Madina Line.Com – Senior Advokat Eggi Sudjana SH MSi dari Kantor Pengacara Eggi Sudjana & Partners menyambangi Kantor Badan Pengawas Pemilihan Umum Republik Indonesia (Bawaslu RI), perihal kaitannya mengenai surat terbuka yang sebelumnya telah dilayangkan Eggi Sudjana sebagai Ketua Dewan Kehormatan Kongres Advokat Indonesia (KAI) yang ditujukan kepada Ketua Komisi Pemilihan Umum Daerah (KPUD) Provinsi Daerah Khusus Ibukota (DKI) Jakarta Drs Sumarno, agar segera mencopot atau membatalkan pencalonan Calon Gubernur (Cagub) DKI Jakarta dengan nomor urut 2 (dua) Basuki Tjahaja Purnama (Ahok).
Eggi Sudjana hadir pukul 11.00 WIB pada Kamis (03/11/2016). Sekitar sejam kemudian, Eggi lalu dipanggil untuk mengadakan diskusi pertemuan dengan para Komisioner Bawaslu yang diwakili oleh Komisioner Bawaslu, yaitu Nelson Simanjuntak, Nasrullah dan rekan komisioner lainnya.
Dalam diskusi yang berjalan dengan alot, yang pada hakekatnya pihak Eggi Sudjana meminta agar Bawaslu RI mengambil sikap tegas akan pelanggaran hukum yang dilakukan oleh Ahok sebagai Cagub nomor urut 2 pada Pemilihan Kepala Daerah (Pilkada) DKI Jakarta 2017. “Dikarenakan berdasarkan perintah Undang-Undang (UU) Nomor 10 tahun 2016 pasal 71 ayat (3) dan (5) mengatakan, Gubernur dilarang mengunakan kewenangan program dan kegiatan yang menguntungkan atau merugikan 1 (satu) pasangan calon baik di daerah sendiri maupun di daerah lain dalam waktu 6 (enam) bulan sebelum tanggal penetapan pasangan calon sampai dengan penetapan calon,” ujarnya, di Kantor Bawaslu Jalan MH Thamrin, Jakarta Pusat (Jakpus) pada Kamis siang (03/11/2016).
Dikatakannya, pada pasal 71 ayat 5 mengatakan; dalam hal Gubernur dan Wakil Gubernur (Wagub), selaku petahana melanggar ketentuan sebagaimana dimaksud pada ayat (2) dan ayat (3), Petahana tersebut dikenai sanksi pembatalan sebagai calon oleh KPU Provinsi atau KPU Kabupaten/Kota. “Bilamana Ahok nantinya terpilih juga, artinya akan ada pihak lain yang akan menggugat dan kita akan tahu sendiri berapa besar kerugian negara dalam hal ini, karena kita pun di sini tidak ditunggangi dari pihak siapapun, kami murni untuk penegakan hukum,” tegas Eggi di hadapan para Komisioner Bawaslu RI, karena dia sebagai pengacara dan ahli hukum merasa terpanggil untuk melakukan tindakan ini.
Ditekankannya kembali, agar Bawaslu bisa mengambil sikap yang tegas untuk mengatasi persoalan pelanggaran hukum yang terjadi ini, agar pihak Bawaslu menghubungi KPUD agar membatalkan pencalonannya. “Telpon dan perintahkan KPUD dan batalkan pencalonan Ahok,” tegas Dr Eggi Sudjana, di hadapan para Komisioner Bawaslu RI.
“Karenanya, agar aksi unjuk rasa besar-besaran yang akan terjadi besok bisa teredamkan kondisinya, saya bukan mencampuri Pilkadanya, tapi saya di sini berlaku untuk menegakkan hukum,” jelasnya.
Sementara itu, di sisi lain, Komisioner Bawaslu RI melalui Nelson Simanjuntak mengatakan, pihaknya siap menjadikan laporan dari pihak Eggi Sudjana (pelapor) sebagai bahan informasi buat Bawaslu RI yang akan disikapi dengan peraturan hukum yang berlaku. “Namun, bilamana juga tidak menghasilkan apapun, pihaknya Eggi akan siap mengangkat kasus permasalahan hukum ini dan KPUD akan menghadapi gugatan pra peradilan Pengadilan Tata Usaha Negara (PTUN),” pungkas Eggi Sudjana.
